1- General Rights

First we should know some general rights guaranteed by the constitution to the citizens of the Turkish state, and these rights are:

  • The right to live humanely: and the Turkish citizen can protect and develop his assets and spiritual status, the right to live without torture or subjection to punishment or treatment inconsistent with human dignity.
  • Freedom: The Turkish citizen is provided by freedom and security. No person can violate his freedom or his security, except in cases of detention or being placed under surveillance in an official authority. The citizen's freedom may not be restricted based on procedures not specified by law.
  • The right to know the reason for arrest: The Turkish citizen has the right to know the reason for his arrest in accordance with the procedures and principles determined by law, he has the right to know what his rights are, and to inform his relatives that he has been arrested. If a citizen is arrested, he has the right to apply to judicial authority to appear in court as soon as possible, or release him immediately if there is an illegal order in the proceedings for his arrest.
  • Privacy of private life: Preserving the privacy of the private and family life of a Turkish citizen, as it is untouchable. Except for search warrants issued by the Public Prosecution and police institutions in accordance with the principles specified by laws.
  • Services rights for Turkish citizens: All Turks have the right to obtain free or paid services within the borders of their country, which are educational, health and cultural services, and to benefit from all social facilities in the country.
  • Turkish citizen has the right to obtain the security and protection from the security authorities in the country, And not to be attacked or harmed.
  • The right to litigation: Turkish citizens must resort to the judiciary to resolve any dispute or problem, obtain any right that was taken from it or sue those who exceeded the legal limits against him, and not to do so without legal cover. The Turkish citizen is also obliged to respect and executejudges rulings.

2- Civil rights

The Turkish legislator has organized citizenship rights in the “basic rights and duties” section in the constitution, that protect the individual from society and the state and these rights are:

  • Obtaining all the identity documents like ID personal card, a Turkish passport or a driver's license and other documents that are required of a Turkish citizen.
  • The right to get a replacement for a lost or damaged personal document that you lose due to loss or damage.
  • The right to document marriage, register newborns, and register deaths.
  • The right to inheritance and succession according to Turkish laws.
  • Freedom of movement within Turkish territory
  • Freedom to travel outside and return to Turkey.
  • The right to review Turkish embassies and consulates in any foreign country to obtain all the services necessary to obtain his civil rights.
  • The right to grant Turkish citizenship to a foreign wife and children from a non-Turkish mother.

3- Economic Rights

Social and economic rights complete each other, and both the 1961 constitution and the 1982 constitution regulate these rights in the same section. Economic rights consist of duties that the state must fulfill in order to ensure the country’s development and achieve the desired “social justice.” The law states that the state must exercise Social and economic rights within the limits of the adequacy of their financial resources, and the following are some of the economic rights.

  • Preserving of agriculture and livestock: The state takes the necessary measures to ensure the development of agriculture and animal husbandry and to assist workers in this field, including providing land to farmers who do not own land or have little land. It makes it easier for them to get the tools and equipment that people working in agriculture and animal husbandry need.
  • Giving manufacturers real value and pricing for their products
  • Establishing a fair wage policy, as it is the duty of the state to do what is necessary for employees to obtain fair wages appropriate for their work.
  • The state is responsible for raising the standard of living of its citizens, protecting and developing them, and creating appropriate working conditions for people. Accordingly, the necessary measures are taken to prevent unemployment and to determine the minimum wage.
  • It is the duty of the state to protect children who are employed at a very early age and work for low wages in unhealthy environments, to provide them with educational opportunities and to improve their working conditions. The state also protects those who are unable to work because of physical and mental disabilities.
  • The right to form a trade union for workers. Employers have the right to establish unions or organizations (such as federations) to protect their economic and social rights and interests.
  • The right of Turkish citizens to apply for public and private jobs in Turkey
  • The right to be paid no less than the minimum wage in Turkey.
  • Obtaining health and social security insurance
  • Right to establish a Turkish company
  • The right to own real estate, own cars and other movable and immovable property, and register them with the official departments in his name.
  • The right to sell property in accordance with Turkish law and dispose of the sales price.
  • The right to open a bank account, deposit and transfer.
  • The right to invest in any field of investment in Turkey.
  • The right to participate in all commercial and economic activities.
  • The right to carry out all legal financial transactions and document them with the authorities in the country.
  • The state is obligated to protect the money of its citizens from damage, theft and fraud in accordance with strict legal rules that ensure that citizens are not exposed to exploitation or fraud.
  • The Turkish state must compensate the damaged property of its citizens as a result of natural disasters, and greatly assist in the compensation processes for unnatural disasters through the country's insurance systems.

4- Political rights

Political rights enable citizens to participate in the government and have a say in the political life. These rights include:

  • The right to vote and to run for parliament elections.
  • The right to vote, run for office, participate in political activity and referendum, in accordance with the conditions specified by law.
  • The right to form political parties.
  • The right to participate in any referendum to know the opinion of the people on some issues and the direct participation of the people in making political decisions.
  • Freedom to join political parties licensed in Turkey or not to join.
  • Participation in municipal, parliamentary and presidential elections, whether nomination or voting
  • Guarantee of freedom of expression
  • Guarantee of freedom of political belief
  • Guarantee of freedom of thought
  • The right to participate in political organizations and institutions and to attend political education courses within the licensed activities.
  • The right to participate in demonstrations and ensure their protection.

5- Religious rights

Turkish law guarantees for Turkish citizens the right to religious belief, and the right to practice in the religious rites in which they believe without causing any harm or restrictions on them. Turkish citizens also have the right to join groups of any religion, provided that this group is not banned in Turkey or prosecuted on charges that violate peace and security in the country.

Duties of Turkish Citizens

After getting acquainted with the rights of the Turkish citizen, it must be emphasized that Turkish citizens have duties, the most important of which are the following points and considerations:

1- Preserving Public Security

A Turkish citizen should preserve public security, and not to participate in any activities that would disturb public security or harm others, whether it is individual or collective crimes or joining to groups that have criminal background.

Turkish law imposes very strict rules on crimes and acts that violate security, and therefore the citizen should not disturb public security.

2- Respect the rights and duties of others

Turkish citizen must respect other citizens, such as wife, neighbor and business partner and colleague, as well as respect the traffic laws and general rules followed in any Turkish institution.

Turkish citizen must follow a set of ethics and not to do any verbal or tangible harm to other citizens. Turkish law punishes all forms of racism, bullying and contempt from others, and violating these laws exposes the violator to accountability.

 

3- Defending the homeland

Every adult Turkish citizen must participate in the mandatory military service and participate in the defense of homeland, with the exception of Syrians who get Turkish citizenship. Those who entered Turkey after the age of 22 are not obligated to be in duty, according to previous agreements between the two countries in this issue.

In other cases of naturalization, the naturalized person of Turkish nationality who is not over 38 years old is obligated to military service.

 

4- Pay taxes and insurance fees

The Turkish citizen must pay taxes and fees imposed by the state in many cases, including the establishment of companies, investment, ownership or assignment of ownership and other cases.

5- Preserving public property

The Turkish citizen must preserve public properties such as parks, sidewalks and all facilities designated for the people, and not damage or ruin it.

On May 13, 2022, the Turkish government issued a decision to raise the amount of obtaining Turkish citizenship through the purchase of real estate to a value of 400,000 dollars instead of 250,000 dollars. The decision has been implemented starting in 12th June 2022.

The investor has the right to buy a real estate or several properties with the new amount of $400,000 in order to obtain citizenship, provided that the investor must keep the property for 3 years and he mustn’t sell the property he purchased for the purpose of citizenship before 3 years from the date of purchasing.
