What is a residence permit in Turkey? 
 

The residence permit is issued by the official Turkish Immigration Department in the form of a personal card that allows its holder to stay in Turkey for periods ranging from 6 months to 3 years and perhaps more, depending on the type of residence and the purpose of obtaining it. The residence permit enables you to live in Turkey, study, invest, marry Obtaining a driver's license, receiving treatment, obtaining a tax number, opening a bank account, establishing companies, and many more.

Types of residence in Turkey? 
 

As the most welcoming country for refugees and migrants in the world, Turkey offers many types of residence permits that vary with the different goals of migrants to it. It offers 6 basic types of residence permits:

 

  • Short term residence permit
  • Family residence
  • Student residence
  • Long-term residence permit
  • Humane accommodation
  • Residence permit for victims of human trafficking.

 

First - short-term accommodation (tourist): 
 

Among the types of residence permits in Turkey, the short-term residence permit may be the most famous and widespread, which is regulated under Articles 31 to 33 of the Law on Foreigners and International Protection No. 6458. Articles 28 and 29 of the Executive Regulations of the Law on Foreigners and International Protection. It is called by many names, most notably tourist accommodation.

 

Who can obtain a short-term residence permit? 
 

1- Foreigners arriving to conduct scientific research. 
2 - Those wishing to buy real estate in Turkey. 
3- Businessmen who will establish commercial relationships or interests. 
4 - Contributors to on-the-job training programmes. 
5- Students who will arrive to attend educational programs or student exchange programs and agreements to which the Republic of Turkey is a party 
6- Foreign tourists wishing to stay for the purpose of tourism
7- Patients who intend to receive treatment provided that they do not suffer from a disease that threatens public health. 
8 - Foreigners who are required to stay in Turkey at the request or decision of the judicial or administrative authorities. 
9 - Those interested in attending and learning Turkish language courses. 
10 - Foreigners who will attend an educational program, research, training or course by means of a public agency 
11 - Students of higher education wishing to transfer to the master's level 
12 - Investors 
13 - Citizens of the Turkish Republic of Northern Cyprus

 

How long is the short term stay? 
 

A short-term residence permit is granted for a minimum period of 6 months, and a maximum of two years, with the possibility of renewal for those who wish to do so, except for the foreigners mentioned in item 13 above.

 

What are the conditions for obtaining a short-term residence permit?
 

- The foreigner is required to fulfill the conditions stipulated in Article 32 of Law No. 6458 to obtain a short-term residence permit, which are: 
- Providing information and supporting documents regarding the reason for staying in Turkey 
- Living in housing conditions that comply with public health and safety standards, 
- Submit a criminal record certificate issued by the competent authorities in the country of citizenship or legal residence upon request 
- Show information about their address of residence in Turkey.

 

In what case is the grant, renewal, or even cancellation of the short-term residency denied? 
 

A short-term residence permit is not granted and will be canceled if it was issued and not renewed in the following cases: 

- one or more of the conditions submitted for obtaining a short-term residence permit has not been fulfilled or is no longer valid, 
- It is established that the residence permit is used outside the purposes for which it was issued 
- When a decision is issued to expel or ban entry to Turkey in relation to the applicant. 
- When staying outside Turkey for more than the number of days allowed annually.

Second - family residence in Turkey 
 

In second place in the list of residency types in Turkey comes the family residency, which is granted based on Articles 34-37 of the Foreigners Law and International Protection Law No. 6458 and Articles 30-34 of the Executive Regulations of the Law on Foreigners and International Protection. 



Who can obtain a family residence permit? 
 

- A foreigner who has obtained a "real estate residence permit" after purchasing a property in Turkey has the right to grant his wife and children family residence 
- Businessmen and business owners who hold a work permit in Turkey have the right to grant their family a family residence permit 
- As well as owners of medical residence who wish to have their families near them are able to grant them a family residence permit 
- In short, family residence is a means of family reunification for any immigrant with a valid residence permit in Turkey 
Note: Family residence covers first-degree family members, husband, wife, and children under the legal age. 
- In the event that one of the spouses applies for a family residence permit for children without the presence of the other party, the consent of the mother or father who lives abroad and who shares custody must be obtained 
 

What is the duration of the family residence? 
 

- The duration of the family residency is related to the type and duration of residency of the sponsor who invited the family and applied for the permit, but it ranges between two and three years, subject to renewal. 
- The family residence permit cannot exceed the duration of the sponsor's residence permit under any circumstances.

 

What are the conditions for obtaining family residence? 
 

The foreigner must fulfill the conditions stipulated in Article 35 of Law No. 6458 to obtain a family residence permit, which are: 

1 - The sponsor must have a valid health insurance that covers all family members 
2 - He must have a monthly income of no less than the minimum wage in Turkey and be financially sufficient to support them. 
3- Not having been convicted of any crime against the family during the five years preceding the application 
4- A resident of Turkey for at least one year with a residence permit and has been registered in the address-based registration system 


In what case is granting, renewing, or even canceling the family residence permit? 
 

1 - The conditions specified for family residence permits have not been met or are no longer valid 
2- It is established that the residence permit is used outside the purposes for which it was issued 
3- There is a current expulsion or entry ban to Turkey in relation to the applicant.
 

Types of Residence in Turkey Family Residence

Third - Student residence in Turkey 
 

We cannot talk about the types of residency in Turkey and not mention the details of the student's residency, which is granted based on Articles 38-41 of the Law on Foreigners and International Protection No. 6458 and Articles 35-39 of the Executive Regulations of the Law of Foreigners and International Protection.

 

Who can obtain student residence in Turkey?

 

Student residence is granted to: 

- High school students over the age of 18 
- Turkish university students 
- Undergraduate and postgraduate students 
- Students who receive education in Turkey to specialize in medicine or dentistry. 


What is the duration of the student residence? 
 

- A student residence permit is granted to cover the period of study for foreigners who will receive education in Turkey through state institutions and organizations 
- If the study period is less than a year, the residence permit period may not exceed the study period. 
- Foreigners receiving primary and secondary education, subject to the consent of their parents or legal guardian, may be granted a one-year student - residence permit and renewed for the duration of their studies.

 

What are the conditions for granting student residence? 
 

Foreigners must fulfill the conditions stipulated in Article 39 in order to obtain a student residence permit, which are: 

1- Providing information and supporting documents related to the purpose of residence in Turkey (Article 38) 
2 - Provide information about their residence address in Turkey. 
3- Health insurance 
 

Can foreign students work in Turkey? 
 

Yes, foreign students enrolled in universities or undergraduate and graduate students can work in Turkey provided they obtain a work permit from the Ministry of Labor and Social Security. 



What are the reasons for rejecting, canceling or not renewing student residence permits? 
 

1 - The requirements for issuing a student residence permit have not been met or are no longer valid 
2 - There is evidence that the study may not continue 
3- Decides that the student residence permit has been used for a purpose other than the one for which it was issued 
4 - There is a current decision of expulsion or entry ban into Turkey in relation to the foreign student.

Fourth - Long-term residency (permanent residency): 
 

Long-term residency or permanent residency, as some call it, may be one of the less common types of residency in Turkey because it is difficult to obtain compared to other types. Long-term residency is granted by provincial directorates to foreigners who have resided continuously in Turkey for more than 8 years without leaving and under Severe conditions, most notably obtaining the approval of the Ministry of the Interior under Law 42-45 of the Law on Foreigners and International Protection and Articles 40-43 of the Regulations for the Implementation of the Law on Foreigners and International Protection. 



Who can apply for a long-term residence permit? 
 

Every foreigner who resides for 8 consecutive years on Turkish territory can obtain long-term residence, except for refugees, beneficiaries of subsidiary protection, those under temporary protection, and holders of humanitarian residence permits. 
 


How long is the long-term residence? 
 

The long-term residency is granted indefinitely, and some call it the golden residency as well, as it enjoys almost the advantages of Turkish citizenship, except for the law of compulsory military service, the right to vote, and exemption from customs duties when importing vehicles. 
 


What are the conditions for obtaining long-term "permanent" residency? 
 

In order to be issued a long-term residence permit, the foreigner must fulfill the conditions stipulated in Article 43 of the Law, namely: 

1 - Obtaining one of the types of residency in Turkey for at least eight years (with the exception of humanitarian residency) 
2- Not receiving aid or social assistance in the last three years 
3- Be covered by valid medical insurance 
4 - The foreigners who receive it should not pose a threat to public order or security 
5- Have sufficient and stable income to support themselves or their families 
Note: (When calculating eight continuous years, the half term of student residence permits, as mentioned in Article 38 of the Act, and the full term of all other types of residence permits) must be taken into account. 


What are the reasons for rejecting or canceling long-term residence permits? 
 

The long-term residence permit is canceled when the foreigner: 
1 - constitutes a serious threat to public security or public order, 
2- He stays outside Turkey continuously for more than a year for reasons other than health, education and compulsory public service in his/her country. 
3 - The long-term residence permit is canceled by the governorate directorate in which the foreigner resides, when he practices a behavior that threatens Turkish society 
Note: Those whose long-term residence permits have been canceled for being outside Turkey continuously for more than a year for reasons other than health, education, employment and mandatory public service in their countries can submit a request to re-activate their card.

Fifth: Human Residency 
 

The humanitarian residence permit is regulated under Articles 46 and 47 of the Law of Foreigners and International Protection No. 6458 and Article 44 of the Executive Regulations of the Law of Foreigners and International Protection, and is granted on humanitarian grounds identified by the United Nations Convention in Geneva in 1951 and signed by 130 countries from Including Turkey. 

There is no specific period of human stay or specific conditions that have been specified, but it is granted in the event that there are justifications for the inability of the foreign refugee to return to his homeland, such as matters related to order, public security, protection of national interests, or any other exceptional circumstances. 
 


Sixth: Residence permits for victims of human trafficking 


The residence permit for victims of human trafficking is regulated by Articles 48 and 49 of the Law on Foreigners and International Protection Law No. 6458 and Articles 45 and 46 of the Executive Regulations of the Law on Foreigners and International Protection. 
 


What are the conditions for obtaining residency for victims of human trafficking? 
 

A residence permit for victims of human trafficking is granted to foreigners who have been victims of human trafficking or where there is strong circumstantial evidence that they may be victims. 
 


How long is the residence permit for victims of human trafficking? 
 

The residence permit for victims of human trafficking is issued for a period of thirty days by the Turkish provincial directorates, and the residence permit can be renewed for a period of six months. However, the total period should not exceed three years. 
 


What are the conditions for obtaining residency for victims of human trafficking? 
 

There are no conditions required to obtain this type of residency in Turkey 
 


What are the reasons for refusing or canceling residence permits for victims of human trafficking? 
 

Like other types of residence permit in Turkey, it is canceled in 3 cases: 
1 - When it is found that foreigners have re-established contact with the perpetrators of the crime of their own free will 
2 - In cases that no longer pose a threat to foreigners. 
3- While it was found that the applicants are not victims
