New rules for the law of obtaining Turkish citizenship by investment

First :Buying property in Turkey from a Turkish citizen exclusively: 


Even before this new rule was included, it was not allowed for any foreign investor who wanted to obtain Turkish citizenship by investment except by buying property in Turkey from Turkish citizens, and it is still in force until now, and a new rule has now been added to it advising on Not allowing the purchase of real estate in Turkey from a partner and children of a foreign person. This means that a Turkish citizen or a Turkish citizen married to a foreigner or foreigner will not be able to sell his or his wife’s real estate to a foreign investor who wants to obtain Turkish citizenship through investment in addition to In addition, the foreign investor will have to verify whether the property owner in Turkey is married to a foreign person. 


Secondly :Selling the property of a foreign investor to a Turkish citizen: 


In the event that the foreign investor sells some of his real estate to a Turkish citizen, and then this Turkish citizen sells the property that has become in his name to another foreign investor, then this foreign investor will be able to benefit from this property in order to obtain Turkish citizenship through Investment, but there are some restrictions on this process, as the original nationality of the previous foreign property owner is similar to the nationality of the new foreign investor, who despite buying this property from a Turkish citizen will not be able to use this property in Turkey for Obtaining Turkish citizenship by investment. 


Third :There should be no nationalities similar to the original nationality of the foreign investor: 


In the event that a foreign investor buys real estate from a Turkish company, it is required that no one of the partners of that company has the same original nationality as this foreign investor, which means that the foreign investor must verify the last company structure of the real estate company In the past, this restriction was directed only to companies in which the investor, his wife or children are partners, but at the present time, the scope and circles of restrictions imposed on nationalities have been expanded. 


Fourthly :The property cannot be used to obtain Turkish citizenship by investment for more than one time: 


Many foreign investors see that this new rule may represent the most important and restrictive change for them, as the new restriction states that Turkey’s real estate that was previously used to obtain Turkish citizenship through investment by a foreign investor cannot be used once. Others, even if a different foreign investor applies for Turkish citizenship and this restriction applies even to shares of real estate. In the event that only one share of a property is used in order to obtain Turkish citizenship by investment, this share will become ineligible Again and not usable in submitting an application for citizenship compared to the rest of the shares of this property in Turkey 


fifth :the process of selling the property after three years: 


Many foreign investors may find that this new rule will create risks for them, and it states that if the property that was used to obtain Turkish citizenship is sold after the end of the three-year ban on selling it to the same previous owner who The foreign investor has purchased it from him, then the Turkish Citizenship Office will have the right to inquire about this sale process. .

 

On May 13, 2022, the Turkish government issued a decision to raise the amount of obtaining Turkish citizenship through the purchase of real estate to a value of 400,000 dollars instead of 250,000 dollars. The decision has been implemented starting in 12th June 2022.

The investor has the right to buy a real estate or several properties with the new amount of $400,000 in order to obtain citizenship, provided that the investor must keep the property for 3 years and he mustn’t sell the property he purchased for the purpose of citizenship before 3 years from the date of purchasing.
